Terms of Service

1. Who we are

Promotor ("the Service") is a web application for financial modelling of Spanish real-estate developments, operated by skep.co ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service is operated by an independent maker. Paid plans are sold by Creem, our merchant of record, which issues your invoice and remits VAT. For anything about the Service or your data: [email protected].

2. Accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. Accounts are individual; access is granted by invitation. You must provide a valid email address and are responsible for the accuracy of the data you enter.

3. The Service is a modelling tool, not advice

All figures, projections, tax estimates and metrics produced by Promotor are indicative estimates for informational purposes only and depend entirely on the assumptions provided. They are not financial, investment, tax or legal advice and must not be relied on as such. Spanish tax treatment is modelled on our best understanding of the applicable rules and may not reflect your specific circumstances. You must verify all results with qualified professional advisers before making any decision. Where a project is shared with you as an investor, the figures are the developer's own inputs; Promotor provides the modelling tool and does not verify or endorse them.

4. Subscriptions and billing

Paid plans are sold and billed by Creem, our merchant of record: the purchase contract for the subscription is with Creem, which issues your invoice and remits VAT. Trials, prices and billing terms are shown at checkout, along with Creem's own terms. You can cancel at any time; access continues until the end of the paid period. We do not store your card details; these are handled by Creem.

5. Right of withdrawal (consumers only)

If you subscribe as a consumer rather than as a business or professional, you have 14 calendar days to withdraw from the contract without giving a reason (art. 102 ff. of the Spanish consumer act, TRLGDCU, implementing Directive 2011/83/EU). Because access begins immediately, by starting a paid plan you expressly ask us to begin performing the service during that period and acknowledge that the right of withdrawal lapses once the service has been fully performed. If you withdraw before then, we charge only the proportion already supplied and refund the rest. Most of our users subscribe as a business, in which case the statutory right of withdrawal does not apply. Because Creem is the merchant of record, you can send a withdrawal notice to Creem or to us at [email protected]; either one reaches the right party.

6. Acceptable use

  • Do not attempt to breach security, access other users' data, or disrupt the Service.
  • Do not upload unlawful content or content you have no right to use.
  • Do not resell or redistribute the Service without our written consent.
  • Automated abuse of the AI or upload features (which incur real third-party costs) may result in suspension.

7. Your content

You retain all rights to the project data and images you upload. You grant us a limited licence to process and store that content solely to provide the Service to you (and to any investor you explicitly share a project with, read-only).

8. Availability and liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties and are not liable for any indirect or consequential loss, or for any decision taken in reliance on the model's output. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

9. Termination

You may delete your account at any time by contacting us. We may suspend or terminate accounts that breach these Terms. On termination we delete or anonymise your data in line with our Privacy Policy.

10. Changes and governing law

We may update these Terms; material changes will be notified in-app or by email. These Terms are governed by Spanish law, and the competent Spanish courts have jurisdiction, without prejudice to any mandatory consumer-protection rights in your country of residence.

11. Complaints

If you have a complaint, write to us first at [email protected] and we will answer within a reasonable time. As a consumer you may also take a complaint to the consumer authorities of your region or country of residence. We are not currently adhered to any consumer arbitration scheme or code of conduct.
